Advertising Contract Terms & Conditions

Provided below are the standard terms and conditions issued to customers signing advertising contracts with Biscayne Times. 


The advertiser shall use the minimum number of ads agreed upon above within the prescribed dates. Unfulfilled contracts or contracts cancelled by the advertiser will be billed at the regular schedule of rates, the difference between the actual number of insertions run and the number agreed upon in the contract. Unfulfilled contracts that received added value or discounted advertising products will be repriced and billed at the regular schedule of rates. Advertisers not fulfilling their contracts will also be responsible for an early termination fee equal to 25% of the contract total.   After the length of the contract is completed, ads will run issue to issue under the same terms until either party gives 30-day notice. Cancellations will not be accepted after the closing date for space reservations. Premium placements on the front/inside/back covers are non-cancellable. Advertising copy from the most recent insertion will run if copy is not received by the specified deadline. If there is no previous insertion, the Advertiser is liable for the cost of contracted space not used, and space will be allocated at the discretion of the Publisher. After materials deadline, a fee will be charged for changes to ad materials already submitted for publication. Advertisers with guaranteed page positions may forfeit said placement if ad materials are not received by the specified submission deadline. The publisher reserves the right to reject or edit advertising copy considered unsuitable for publication. The publisher shall not be liable for damage if, for any reason, the advertisement is not published. Publisher's sole liability (and Advertiser’s and Agent’s sole remedy) for errors and/or omissions by Publisher in published advertisements (including, but not limited to, failure to publish an advertisement) shall be to provide a paid make-good in the next available issue. The Publisher shall have no liability unless the error or omission is brought to the Publisher's attention no later than 5 working days after the advertisement is published. Advertisers and advertising agencies assume liability for all content of advertisements printed and also assume responsibility or any claims arising therefrom against the publisher, including claims or suits of libel, violation of rights to privacy, plagiarism, copyright infringement, or trademark/patent infringement. Advertising artwork created by our design staff is solely for use in Biscayne Times; Biscayne Times retains the copyright on this material. Any use of this advertisement in another publication without the express written consent of Biscayne Times is expressly prohibited. All rates are NET. Late payments are subject to finance charges at the maximum rate Florida law allows. Publisher may hold advertiser and its agency jointly and severally liable for all sums due and payable to the publisher. We may initiate collections against any past-due invoices. We may engage a third-party firm or agency to manage this collections process on behalf of Biscayne Times, and you may be liable for any fees or charges that a third party may assess.
